Welcome to PhotoX AI. These Terms of Service ("Terms") govern your use of the PhotoX AI application and services ("Service"), provided by PhotoX AI ("we", "our", or "us"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Services Description

PhotoX AI is an AI-powered image transformation application that allows users to convert their photos into various artistic and stylized images using our range of transformation workflows. The Service operates on a credit-based system, where users spend credits to generate transformed images.

3. User Accounts and Registration

3.1 Device Identification

Our Service may identify you through your device identifier. We may collect device characteristics to create a unique fingerprint for identifying returning users. This helps maintain your credit balance and access to your generated images across app reinstalls.

3.2 User Responsibilities

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Credit System

4.1 Credit Purchases

Credits can be purchased through in-app purchases. We offer different subscription plans that provide a certain number of credits:

• Weekly subscription: 100 credits
• Monthly subscription: 500 credits
• Annual subscription: 10,000 credits

4.2 Credit Usage

Credits are spent to generate transformed images. Each transformation workflow has a specific credit cost. Credits will be deducted from your balance when you request an image transformation.

4.3 Refunds

If image generation fails due to a technical error on our side, the credits will be refunded to your account. For subscription or purchase-related refunds, please refer to the refund policy of your app store platform (Apple App Store or Google Play Store).

5. User Content

5.1 Your Content

You retain all rights to the photos you upload to our Service. By uploading photos, you grant us a temporary, non-exclusive license to use, process, and transform your content solely for the purpose of providing our Service to you.

5.2 Generated Images

You own the rights to the images generated using our Service, subject to the following conditions:

• You may not use generated images for illegal, harmful, or offensive purposes.
• You may not claim that the AI models or technology used to generate the images are your own.

6. Prohibited Uses

You agree not to use the Service for any purpose that is illegal or prohibited by these Terms. Prohibited uses include but are not limited to:

• Using the Service to create, upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Attempting to probe, scan, or test the vulnerability of the Service or any related system or network.
• Using the Service to generate images that infringe on the intellectual property rights of others.
• Using the Service to create deepfakes or misleading content intended to harm others.
• Attempting to circumvent the credit system or any other limitations of the Service.

7. Intellectual Property

7.1 Our Content

The Service and its original content (excluding user-provided content), features, and functionality are and will remain the exclusive property of PhotoX AI and its licensors. The Service is protected by copyright, trademark, and other laws.

7.2 Feedback

If you provide us with any feedback or suggestions regarding the Service, you assign to us all rights in such feedback and agree that we have the right to use and act on such feedback without any restrictions or compensation to you.

8. Limitation of Liability

To the maximum extent permitted by law, in no event shall PhotoX AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

9. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
